GoodGrove is operated by Arven Brands LLC (“GoodGrove,” “we,” “us,” or “our”), a New York limited liability company with a mailing address at 418 Broadway, Ste N, Albany, NY 12207. These Mobile Messaging Terms (the “SMS Terms”) govern your participation in the GoodGrove text-message program (the “Program”) and form a binding agreement between you and GoodGrove. By enrolling in the Program, you agree to these SMS Terms, our Terms of Service, and our Privacy Policy. If you do not agree, do not enroll, or follow the opt-out instructions in Section 6 below.
SECTION 1 - PROGRAM DESCRIPTION
The Program delivers recurring marketing text messages from GoodGrove to mobile numbers that have opted in. We send Program messages through our SMS provider, Klaviyo, Inc. (“Klaviyo”). Program content may include promotional offers, new-product announcements, restock alerts, cart-abandonment reminders, occasional surveys, and similar marketing communications. We may add or remove message types at our discretion, subject to applicable law and these SMS Terms.
SECTION 2 - HOW TO OPT IN
You can enroll in the Program through any of the following channels:
- Checking the SMS opt-in checkbox at checkout on trygoodgrove.com. The checkbox is unchecked by default and is separate from any email-marketing checkbox, in compliance with the Federal Communications Commission’s 2024 one-to-one consent rule.
- Texting a designated keyword to GoodGrove’s SMS short code or long code, where such keyword and number have been published by GoodGrove.
- Submitting your mobile number through an SMS opt-in form on trygoodgrove.com (for example, a pop-up, embedded form, or landing page).
Prior express written consent. By opting in, you provide your prior express written consent under the Telephone Consumer Protection Act (47 U.S.C. Section 227 et seq.) and applicable Federal Communications Commission regulations to receive recurring autodialed marketing text messages from GoodGrove at the mobile number you provide. You acknowledge that the Program uses an automatic telephone dialing system or other automated technology to deliver messages, and that consent to receive marketing text messages is not required to purchase any goods or services from GoodGrove.
SECTION 3 - MESSAGE FREQUENCY
You may receive up to eight (8) marketing messages per month through the Program, plus occasional transactional messages related to your orders or subscription (for example, shipment notifications, delivery updates, subscription renewal reminders where applicable, and other customer-service messages). Frequency may vary based on your activity, your subscription status, and the cadence of our marketing calendar.
SECTION 4 - CARRIER DISCLAIMER; COST
Msg & data rates may apply. Standard message and data rates charged by your wireless carrier may apply to each message you send or receive in connection with the Program. You are solely responsible for all charges assessed by your wireless carrier. Neither GoodGrove nor Klaviyo is responsible or liable for delayed, undelivered, or misdirected messages, for any failure of your wireless carrier to deliver messages, or for any acts or omissions of your wireless carrier. Wireless carriers are not liable for delayed or undelivered messages.
SECTION 5 - CONSENT IS NOT A CONDITION OF ANY PURCHASE
Consent to receive marketing text messages from GoodGrove is not a condition of any purchase. You may purchase products and services from GoodGrove without enrolling in the Program. Enrollment is voluntary, and you may opt out at any time using the instructions in Section 6.
SECTION 6 - HOW TO STOP — OPTING OUT
You may withdraw your consent and stop receiving marketing text messages from the Program at any time by replying with any of the following keywords to any GoodGrove text message:
STOP, END, CANCEL, UNSUBSCRIBE, or QUIT
Your opt-out request will be processed immediately upon receipt. After we receive your request, you will receive one final confirmation message acknowledging your unsubscribe. After that confirmation message, you will not receive additional marketing messages from the Program unless you re-enroll.
You may also email support@trygoodgrove.com to request removal from the Program. Please include the mobile number you wish to unsubscribe so we can match it against our records.
SECTION 7 - HOW TO GET HELP
For help with the Program, reply HELP to any GoodGrove text message. You will receive an automated response containing GoodGrove’s contact information and a link to these SMS Terms. You may also email support@trygoodgrove.com for assistance.
SECTION 8 - TRANSACTIONAL VS. MARKETING MESSAGES
The Program operates two separate message tracks: marketing messages and transactional messages. Customers who opt out of the marketing track using the keywords in Section 6 may continue to receive transactional messages tied to active orders, subscriptions, or accounts — for example, order confirmations, shipment notifications, delivery updates, account-change confirmations, security alerts, and other communications necessary to complete or service a transaction you have initiated. To stop transactional messages tied to an active subscription, you must cancel the underlying subscription in accordance with our Subscription & Cancellation Policy.
SECTION 9 - ELIGIBILITY
You must be at least 18 years of age to enroll in the Program. The Program is available only to wireless customers of supported United States carriers. By enrolling, you represent and warrant that (a) you are at least 18 years old, (b) you are a resident of the United States, (c) you are the subscriber of the mobile number you provide or have express authorization from the subscriber to enroll that number in the Program, and (d) you will notify GoodGrove promptly if your mobile number changes or is reassigned.
SECTION 10 - FLORIDA TELEMARKETING ACT
To the extent applicable, GoodGrove endeavors to comply with the Florida Telemarketing Act, the Florida Telephone Solicitation Act, and the Florida Do Not Call Program. GoodGrove may presume you are a Florida resident if your shipping address is in Florida or your mobile phone area code is a Florida area code, in which case the Florida Telemarketing Act may apply to your communications with us. If you are not a Florida resident, you agree not to assert claims against GoodGrove under the Florida Telemarketing Act, the Florida Telephone Solicitation Act, or the Florida Do Not Call Program.
SECTION 11 - PRIVACY
Information you provide in connection with the Program — including your mobile number, opt-in source, message history, and engagement metadata — is collected, used, and disclosed in accordance with our Privacy Policy. We share this information with Klaviyo and the wireless carriers necessary to deliver the messages. We do not sell mobile numbers collected through the Program, and we do not share Program-collected mobile numbers with third parties for those third parties’ own marketing purposes.
SECTION 12 - CHANGES TO THESE SMS TERMS
We may modify these SMS Terms from time to time. For material changes, we will provide at least thirty (30) days’ advance notice before the change takes effect by posting the updated SMS Terms on trygoodgrove.com and, where we have your contact information, by email or text message. Your continued participation in the Program after the effective date of any modification constitutes your acceptance of the updated SMS Terms. If you do not agree to the modified SMS Terms, you must opt out using the instructions in Section 6 before the effective date of the change.

SECTION 14 - CARRIER COMPATIBILITY
The Program is compatible with most major United States wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, MetroPCS, Boost Mobile, U.S. Cellular, Cricket Wireless, and Virgin Mobile. The Program may not be available on all carriers, and supported carriers may change without notice. Wireless carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier’s coverage, network conditions, and device settings, none of which are controlled by GoodGrove or Klaviyo.
